Conveyancing Process Step by Step
Step 1
- Transfer Attorney receives the Offer to Purchase Agreement. The Seller and Purchaser are contact and various documents and information are requested from both parties, including FICA documents.
Step 2
- Transfer Attorney requests the title deed and discharge figures from the current bondholder
Step 3
- Bond Cancellation Attorney is instructed by the current bondholder
- Bond registration Attorneys is instructed by the Bank
Step 4
- Bond Attorney writes to the transfer attorneys advising the amount available for guarantees
- Cancellation Attorneys write to the transfer attorneys advising of the amount required to cancel the existing bond.
Step 5
- Transfer Attorney prepares the transfer documents, applies for rates and levy clearance certificates from the Municipality or Managing Agents
- Transfer Attorney requests the guarantee from the bond registration attorneys
Step 6
- Transfer Attorney requests all parties to sign transfer documents and payment of transfer costs
- Bond Attorney requests purchaser to sign bond documents and pay bond registration costs
Step 7
- Transfer Attorney receives costs and attends to payment of transfer duty to SARS
- Transfer Attorney receives the transfer duty receipt from SARS
Step 8
- Pay Rates/Levy Assessment (Seller liable for such payment)
Step 9
- Transfer attorney receives guarantees from bond registration attorneys and provides same to the Bond Cancellation Attorney
Step 10
- Transfer attorney receives rates clearance certificate and levy clearance certificate
Step 11
- Cancellation attorney should be ready to lodge at this point
- Transfer attorney should be ready to lodge at this point
Step 12
- Bond Attorney awaits proceed from the Bank to proceed with lodgement
- Cancellation Attorney awaits proceed from the Bank to proceed with lodgement
- Bank turnaround time for both the above is between 7-10 working days
Step 13
- The transfer attorney, bond attorney and cancellation attorney arrange simultaneous lodgement of the documents in the Deeds Office.
Step 14
- Once lodged, the documents will be examined between 7-10 working days and the matter will then come up for “prep”
Step 15
- Matter is on “Prep”. All attorneys are required to advise the Deeds Office to proceed with registration (usually the next working day)
Step 16
- Matter is Registered in the Deeds Office.
Step 17
- Guarantees are paid out and received into the transferring attorney account. Final accounts and payments to all parties is finalised.
